Terms of Service

These Terms of Service (“Terms”) govern your use of Offshore Advantage, owned and operated by Ironclad Holdings LLC (“Company”, “we”, “us”, or “our”). By signing up for our service, you agree to these Terms.
1. Service Description
Offshore Advantage provides AI-powered booking agent technology for charter fishing captains. Our service includes:
- —A custom AI voice booking agent configured for your charter operation
- —Automated call handling, booking inquiry capture, and message taking
- —Post-call data extraction and reporting
- —A dedicated phone number for your AI agent
2. Subscription Plans and Billing
We offer monthly subscription plans. Your subscription fee is billed on the same date each month. All fees are non-refundable except as required by law.
Included Minutes — Each subscription plan includes 100 minutes of AI call handling per month.
Overage Charges — Usage exceeding 100 minutes per month will be billed at $0.25 per minute. Overage charges are automatically applied to your payment method on file at the end of each billing period.
Price Changes — We reserve the right to change subscription pricing with 30 days written notice.
3. Acceptable Use
You agree to use Offshore Advantage only for lawful purposes. You may not:
- —Use the service for any illegal activity
- —Misrepresent your business or services to callers
- —Attempt to reverse engineer or copy our technology
- —Resell or sublicense access to the service without written permission
4. Call Recording Compliance
You are solely responsible for compliance with all applicable call recording laws in your jurisdiction. This includes notifying callers that their call may be recorded or monitored. Offshore Advantage is not liable for your failure to comply with applicable recording laws.
5. Service Availability
We strive for maximum uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party providers including but not limited to Retell AI, Telnyx, or Twilio.
6. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
7. Termination
We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or fraudulent activity. We will provide notice where reasonably possible.
8. Limitation of Liability
To the maximum extent permitted by law, Ironclad Holdings LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Offshore Advantage. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
10. Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by email. Continued use of the service after notice constitutes acceptance of the updated Terms.
